There are numerous examples where brand names, logos, company names, etc. are the most valuable asset of a company. The trademarks of Apple, Google, Amazon, Coca-Cola or Microsoft can regularly be found at the top of trademark rankings and their value is assessed at several billion US-Dollars.
Therefore, it is very important to protect and register a trademark, brand name, logo, company name or name to get a registered trademark in every country where they are used to defend yourself against copycats.
Several questions must be addressed before you apply for a trademark in order to secure the best trademark protection. Presumably they are tailored to the needs of a trademark applicant which makes an individual consultation necessary.
In connection with trademark protection, typical questions of trademark applicants are the following:
- Should I apply for a German trademark at the GPTO (German Patent- and Trademark Office) to get a trademark registration in Germany? Or is an application for a union trademark (“EU-trademark“) at the EUIPO (European Intellectual Property Office) the best choice to get protection in various countries of Europe through a common trade mark registration?
- Should I register a wordmark, a figurative mark or a word and device mark? Or which other category of trade marks best fits my needs?
- For which goods and/or services according to the so called Nice classification should the trademark application in Germany or Europe be registered?
At minimum, a basic trademark search for identical marks is generally recommended.
Dr. Markus Lichtnecker (European Patent, Trademark and Design Attorney) and Dr. Florian Lichtnecker (Certified IP Lawyer) are lawyers for trademarks and are happy to answer any questions you have in regards to German and European Trademark Law.
